What information do we collect?
We collect two types of information about users of our Website: Personally Identifiable Information and Other Information.
Personally Identifiable Information (PII) means information that would identify you, directly or indirectly, such as your name, mailing address, email address, username, date of birth, payment card information, or telephone number. Other Information means information that does not or could not reasonably be used to identify a specific individual. We may combine Other Information with PII, in which case we will treat the combined information as PII.
When you use this Website, we collect various types of PII, including:
When you create a user account we may request that you create a unique username and password and provide us with certain PII, such as, first name, middle initial, last name, email address, date of birth, mailing address, and telephone number. After you create an account, you may choose to provide additional information in your account such as a nickname or description of yourself or your skills. For each entry into your memory box, we may collect title, grade, date, description, purpose, category, and tags associated with that memory, along with any photographs, video, audio, document, or other uploaded file you put into the Website.
We collect PII from you when you interact with this Website by filling out a form in other contexts, such as submitting a customer service request, filling out an interest form, adding a memory box to your account, adding a memory into your memory box, conducting a purchase transaction, or participating in a public discussion forum.
We use third-party payment services, such as PayPal. In connection with an LDI transaction, PayPal and other third-party payment services may ask you for the following information: first name, last name, billing address, city, state and zip code or postal code, phone number, credit card number, security code, and credit card expiration date.
This Website may contain blogs, bulletin boards or other public forums where free form entry is permitted. We highly recommend that you do not post your PII or other sensitive or private information when using these features. If you provide any information through any of these features, then such information will be posted publicly.
If you provide feedback or contact us via email, we will maintain your name, email address, and content of your feedback in order to reply and/or to enhance user experience.
If you participate in a contest, sweepstakes, or other promotion, we will collect any data you provide in connection with that promotion.
We may also obtain information from other sources, such as Household-level or Census-level information we obtain from third parties, and combine that with information we collect on our Website.
We also collect Other Information from your computer or device, such as browser type, operating system, referring pages, pages visited, time spent on a particular page, geolocation information, and IP address. LDI and our service providers may also automatically collect Other Information through the use of electronic tools like cookies, web beacons or pixel tags, and server logs, which are defined in the “Helpful Definitions” section below.

How do we use this information?

We use PII to provide products and services to you, improve our marketing and promotional efforts, analyze and enhance Website and other service operation and use, improve product and service offerings, enable our corporate affiliates and business partners to provide offers for products and services that may be of interest to you, and to otherwise tailor your experience. We may also use PII to contact you, troubleshoot issues, provide marketing and promotional information, enable you to communicate, collaborate and share content, share testimonials, feedback, or comments, process and complete transactions, resolve disputes, accomplish administrative tasks, enforce our agreements with you (including our Website Terms & Conditions and this Privacy Policy), investigate and prevent unauthorized access to LDI Services or Software, fraudulent transactions, and other illegal activities, comply with applicable laws, and cooperate with law enforcement activities.

We use Other Information to troubleshoot issues, administer and enhance the Website and other services, analyze usage of our software, gather demographic and other user information, share testimonials, feedback, or comments, provide offers for products and services that may be of interest to you, investigate and prevent unauthorized access to LDI services, fraudulent transactions, and other illegal activities, comply with applicable laws, and cooperate with law enforcement activities. We may also post or otherwise publicly disclose Other Information on the Website or in publicly-available materials for promotional and marketing purposes.

How do we disclose this information?

We may disclose information to third parties for a variety of purposes, including:

To our corporate affiliates and business partners for the purposes described in this Privacy Policy, including but not limited to providing offers for products and services that may be of interest to you.
To third-party service providers to help us manage and improve the Website and provide our services to you. For example, we may use third-party companies to provide services for us, including but not limited to providing customer and Internet services, customer sign-up, conducting LDI promotions and surveys, assistance in maintaining and managing customer information, and communicating effectively with our customers. Some of these third-party companies are given access to some or all of the information you provide to us, including your email address, and may use cookies on our behalf.
To allow third parties such as Facebook, Instagram or other services to enable “Like” and general login features. To enable these social media sharing and login features, the Website may integrate certain third-party plug-ins. Even if you do not click on these plug-ins, they may collect information about you, such as your IP address and the pages that you view. They also may set and/or access a cookie on your device. These plug-ins are governed by the privacy policy of the company providing them.
To publish testimonials, feedback, and/or comments we receive from users who have had positive experiences with our services.
To allow you to share content and information. Please be mindful of your own privacy needs as you choose who and what to share and/or make public. We cannot control the privacy or security of information you choose to make public or share with others.
To share PII and Other Information upon a merger, sale, or bankruptcy. In the event that LDI is acquired by or merged with a third-party entity, we reserve the right, in any of these circumstances, to transfer or assign PII and Other Information we have collected from our users as part of such merger, acquisition, sale, or other change of control. Any PII transferred would remain subject to this Privacy Policy. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your information is treated, transferred, or used.
For legal purposes, such as when we believe, in our sole reasonable discretion, that doing so is necessary to comply with applicable laws or a court order, subpoena, or other legal process; to investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of our terms and conditions, or situations involving threats to our property or the property or physical safety of any person or third party; or to establish, protect, or exercise our legal rights or defend against legal claims.
For purposes of sharing anonymized or aggregated information, such as publishing a report on Website usage trends.

What about third-party analytics and advertising?

We partner with third parties to collect Other Information to engage in analysis, auditing, research, and reporting. These third parties may set and access cookies on your computer or other device and may use pixel tags to collect information about your activity on the Website. For example, we currently use Google Analytics as an analytics provider. To learn more about the privacy policy of Google Analytics, refer to Google’s “Policies and Principles” or the “Google Analytics security and privacy principles.” Click here to use the Google Analytics Opt-out Browser Add-on to prevent analytics information from being sent to Google Analytics.

LDI may use advertising services provided by third parties to display ads on this Website or on other websites. Some of these ads may contain cookies or pixel tags that are set by third parties (advertisers, sponsors) and may use Other Information about your visits to this and other sites in order to provide advertisements about goods and services of interest to you. For example, third parties may use the fact that you visited our Website to target online ads to you on other websites or mobile apps. In addition, third parties might use information about your use of our Website and other websites to help target advertisements based on your online activity in general. For information about interest-based advertising practices and to opt out, please visit the Network Advertising Initiative website at www.networkadvertising.org/choices or the Digital Advertising Alliance website at www.aboutads.info/choices. Please note that our Website currently does not respond to “Do Not Track” browser headers.

LDI does not control the linking practices of advertisers or sponsors and does not monitor or claim responsibility for any content or privacy practices of such websites. Once you have clicked on an advertisement and have left this Website, you must read the privacy policy of the advertiser or sponsor to see how your information will be handled.

LDI may offer contests, sweepstakes, and promotions that are sponsored by third-party advertisers or sponsors. These third parties may obtain PII that visitors and customers voluntarily submit to participate in the activity. LDI does not control the third parties’ use of information.

Do we connect to external websites?

Occasionally, you will find links from LDI to independently owned, controlled, and/or managed websites whose content we believe will be of possible interest and value to our visitors and customers. Additionally, you’ll see links from advertisers, sponsors, and other partners who may use an LDI owned logo as part of a co-branding agreement.

In many cases, these links represent cooperative projects or mutual links established with the organizations connected with these sites. We do not control the content of these links. These other sites may send you their own cookies, collect data, or solicit personal information. We do not control these cookies or the content of these third parties.

Once you leave our servers (you can generally tell when you leave our Website by checking the URL in the location bar on your browser), the use of any information collected from you is governed by the privacy policy of the operator of the site you are visiting. That policy may differ from ours. If you cannot find the privacy policy of any of these sites via a link from that site’s Home page, you should contact the site directly for more information prior to using that site.

We specifically recommend that users between the ages of 13 to 17 check with their parents and/or guardians before connecting to any new websites, and we request that parents and/or guardians communicate that to their children.

Do we collect information from children?

This is a general-audience website and is not directed to users under the age of 13. We do not knowingly collect PII directly from children under the age of 13 without parent or guardian consent. If you believe that we might have any PII submitted directly from a child under 13, please Contact Us. We will attempt to delete the information as soon as possible.

Children age 13 to 17 may use the Website, but we recommend parent/guardian supervision for these users. Supervision within MyDigitalMemoryBox.com can be obtained by having the parent/guardian create the Main User Account (initial person who formally signs up for the account), and then that parent/guardian can “Add Memory Boxes” for the household once logged into the system.

What about information security and options?

LDI has reasonable technical, administrative, and physical security measures in place to protect against the loss, misuse, and alteration of the information under our control. However, you should understand that “perfect security” cannot be guaranteed.

You can access and update the PII we have about you through the Account Settings area of the Website after you log-in. In some cases, another user within your household may create an account on your behalf and may provide your information, including PII. We collect PII information under the direction of our customers and often have no direct relationship with the other individuals whose information we process. If an account was created for you and you would no longer like us to process your information, please contact the account owner within your household who created your account.

You can opt-out of being sent promotions and/or surveys from LDI by clicking on the unsubscribe link included at the bottom of marketing emails. If you opt out, we may still send you non-marketing emails. Non-marketing emails include emails about your accounts and our business dealings with you. You may request that we do not disclose your Personal Information to unaffiliated third parties for their own direct marketing purposes on a going-forward basis by contacting us by email at [email protected].

If you are a California resident under 18 years of age and a registered user of our services, you may request that we remove content and information that you post on our services. To obtain removal of such content and information, please send us an email to [email protected] with a short description of the content or information you would like to have removed. Please note that such a request does not necessarily ensure complete or comprehensive removal of content posted by you, since the content and information may remain in our databases, may remain visible in a manner that does not identify you, or may have been re-posted by another user.

An “IP address” is a number that is assigned automatically to your computer whenever you use the World Wide Web. Web servers — the big computers that “serve up” Web pages — automatically identify your computer by its IP address.

A “pixel tag” or “web beacon” is a small string of software code that represents a graphic image request on a web page or email.
